Terms of Service

These Terms of Service ("Terms") govern your access to and use of BuildMagic ("the Service"), operated by BuildMagic ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Service" refers to the BuildMagic platform, including the web application, API, build infrastructure, and all related services available at buildmagic.dev.
  • "User" refers to any individual or entity that creates an account or uses the Service.
  • "Team" refers to an organizational unit within the Service that groups users, applications, and billing.
  • "Content" refers to source code, build artifacts, configuration files, certificates, and any other data you upload to or generate through the Service.

2. Account Registration

To use the Service, you must create an account using a valid email address or by authenticating through a supported third-party provider (GitHub, GitLab). You are responsible for:

  • Maintaining the security of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized access to your account.

You must be at least 16 years old to use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Service Description

BuildMagic is a continuous integration and continuous delivery (CI/CD) platform for mobile application development. The Service provides:

  • Automated building of iOS and Android applications.
  • Integration with Git providers (GitHub, GitLab) for source code access.
  • Code signing management for iOS certificates, provisioning profiles, and Android keystores.
  • Build artifact storage and distribution.
  • Team management and collaboration features.
  • Build pipeline configuration and workflow management.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Build, distribute, or host malicious software, malware, or any application designed to harm users or systems.
  • Mine cryptocurrency or perform any computation unrelated to building mobile applications.
  • Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service in a way that could impair, overburden, or damage the infrastructure.
  • Upload content that infringes on the intellectual property rights of others.
  • Share your account credentials with unauthorized third parties.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Your Content

You retain all ownership rights to your Content. By using the Service, you grant us a limited license to access, store, and process your Content solely for the purpose of providing the Service. This includes:

  • Cloning your repositories to execute builds.
  • Storing build artifacts, logs, and configuration files.
  • Storing code signing credentials (certificates, profiles, keystores) in encrypted form.
  • Processing your Content through build pipelines as configured by you.

We do not claim any ownership of your Content. We will not access, use, or share your Content for any purpose other than operating the Service, unless required by law.

6. Code Signing Credentials

The Service allows you to upload code signing credentials including iOS distribution certificates, provisioning profiles, App Store Connect API keys, and Android keystores. You acknowledge that:

  • You are solely responsible for the security and proper use of your code signing credentials.
  • We store these credentials using encryption at rest, but you should maintain your own backups.
  • We are not responsible for any consequences arising from compromised credentials that were uploaded to the Service.
  • You must have the legal right to use any certificates and credentials you upload.

7. Third-Party Integrations

The Service integrates with third-party services including GitHub, GitLab, and Apple App Store Connect. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or security of third-party services.

When you connect a Git provider, we use OAuth tokens to access your repositories on your behalf. We only access repositories that you explicitly authorize for use with the Service.

8. Billing and Plans

The Service offers different plans with varying build minute quotas, team sizes, and feature access. By subscribing to a paid plan, you agree to:

  • Pay the applicable fees as described at the time of purchase.
  • Provide accurate billing information.
  • Accept that plan changes take effect immediately and usage quotas are updated accordingly.

We reserve the right to change pricing with reasonable notice. Build minutes that exceed your plan's quota may result in builds being queued or declined until your next billing cycle.

9. Service Availability

We strive to maintain high availability of the Service, but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible).
  • Infrastructure issues beyond our control.
  • Emergency security patches or updates.

We are not liable for any damages resulting from Service downtime or interruptions. Current system status is available at buildmagic.dev/status.

10. Termination

You may close your account at any time. Upon termination:

  • Your access to the Service will be revoked.
  • Your Content, including build artifacts, logs, and code signing credentials, will be deleted within 30 days.
  • Any remaining balance or prepaid amounts are non-refundable unless required by law.

We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or if we discontinue the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless BuildMagic and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Applications built, signed, or distributed using the Service.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
